1. Acceptance of Terms
TuConnect ("TuConnect", "we", "us", or "our") operates an AI-powered career ecosystem connecting African talent with opportunity. Our platform encompasses two core offerings: TuConnect Grow, providing intelligent career tools for job seekers, students, and professionals; and TuConnect Hire, providing evidence-based recruitment, candidate management, and assessment workflows for employers.
By creating an account, accessing, or using our websites, applications, APIs, or services (collectively, the "Services"), you agree to be bound by these Terms of Use ("Terms"). If you accept these Terms on behalf of a company, organisation, or employer, you represent and warrant that you have full legal authority to bind that entity to these Terms.
These Terms incorporate by reference our Privacy Policy, Cookie Policy, Acceptable Use Policy, AI Transparency & Responsible AI Policy, and Data Processing & Retention Policy. If you do not agree with any part of these Terms, you must not access or use the Services.
2. Eligibility
To use TuConnect, you must meet the following eligibility requirements:
Age requirement. You must be at least 18 years old, or the legal working age in your jurisdiction (whichever is higher), to register an account. If you are between 16 and 18 years old, you may use TuConnect Grow solely with the verifiable consent and supervision of a parent or legal guardian.
Employer authorization. Accounts registered under TuConnect Hire must represent legitimate businesses, organisations, or legal entities. You must provide accurate corporate registration details and use authorized corporate email addresses.
Compliance with laws. You represent that your registration and use of the platform do not violate any applicable local, national, or international law, sanction, or employment regulation in Kenya or your country of residence.
3. User Accounts
You are responsible for maintaining the confidentiality and security of your TuConnect account credentials.
Account security. You must choose a strong password and keep your login details strictly confidential. You are fully responsible for all activities, actions, and uploads occurring under your account.
Accurate details. You agree to provide accurate, current, and complete registration information and to update your profile immediately whenever your contact or professional information changes.
Prohibition on account transfers. Accounts are non-transferable. You may not sell, trade, license, or transfer your TuConnect account, candidate database access, or credit balance to any third party without explicit written permission from TuConnect.
Unauthorized access. You must notify us immediately at support@tuconnect.app if you suspect any security breach or unauthorized access to your account.
4. User Responsibilities
Every user of the TuConnect ecosystem agrees to adhere to standards of professional conduct, integrity, and honesty.
Truthfulness of disclosures. Job seekers must ensure all uploaded CVs, work histories, educational qualifications, project samples, and interview answers reflect accurate personal records. Employers must ensure all posted vacancy details, salary ranges, and company descriptions reflect genuine opportunities.
Professional communication. All messages, application notes, feedback comments, and inquiries transmitted through the platform must remain respectful, professional, and free from harassment or abusive language.
Prompt cooperation. Users agree to cooperate with TuConnect security teams during routine account verification, identity checks, or compliance audits.
5. Acceptable Use
Our Acceptable Use Policy defines strictly prohibited activities across the entire platform. You agree that you will not:
Platform interference. Attempt to bypass security controls, probe network vulnerabilities, introduce viruses, Trojan horses, or malicious code, or engage in denial-of-service (DoS) attacks.
Automated scraping. Use automated scripts, spiders, bots, web scrapers, or data extraction tools to harvest candidate profiles, employer details, job postings, pricing data, or AI-generated output from TuConnect without explicit written authorization.
Misrepresentation & fraud. Impersonate any person, employer, recruiter, or entity, or submit fake job applications, fraudulent CVs, or misleading recruitment listings.
Unsolicited marketing. Use candidate contact information obtained via TuConnect Hire to send unsolicited commercial emails (spam), non-employment solicitations, or marketing campaigns.
Discrimination & harassment. Post content or engage in practices that discriminate on the basis of race, gender, ethnicity, religion, disability, age, or marital status, in violation of local labour laws or international human rights standards.
6. AI-Generated Content & Transparency
TuConnect integrates advanced artificial intelligence across TuConnect Grow (AI Resume Builder, AI Cover Letter Builder, AI Job Tracker, Career Copilot) and TuConnect Hire (candidate evaluation assistance, resume scoring, job description optimisation). Our AI Transparency & Responsible AI Policy establishes the following rules:
Guidance and drafting tool. AI-generated outputs, including ATS resume scores, tailored bullet points, cover letter drafts, interview practice scenarios, and career guidance: are provided as intelligent suggestions to assist your decision-making. AI models do not guarantee employment, recruiter callbacks, or job offers.
User verification duty. You retain complete responsibility for reviewing, fact-checking, editing, and verifying all AI-generated content before downloading, exporting, submitting, or acting upon it. TuConnect is not liable for errors, omissions, or misstatements contained in unedited AI drafts.
No automated black-box rejections. On TuConnect Hire, AI tools support human recruiter decision-making. We require employers to maintain human oversight over all shortlisting, interviewing, and hiring decisions.
Responsible model training. Personal CV data and candidate application contents are not sold to third-party AI developers. Processing occurs under strict security controls detailed in our Privacy Policy.
7. User Content Ownership
You maintain full ownership of all materials you upload, generate, or store on TuConnect.
Your Content remains yours. You retain all intellectual property rights in your CVs, cover letters, application history, portfolio links, company descriptions, and uploaded job requisitions ("User Content").
Limited operational license. By uploading or generating User Content on TuConnect, you grant us a worldwide, non-exclusive, royalty-free, limited license to host, store, process, display, format, and transmit your User Content solely to provide, support, and deliver the Services to you (e.g., rendering your resume, processing ATS scores, or delivering applications to employers you select).
Data portability & deletion. You can export, download, or delete your User Content at any time through your dashboard. Upon account closure, your User Content is handled in accordance with our Data Processing & Retention Policy.
8. Intellectual Property
The TuConnect platform, software, design system, brand assets, and proprietary content are fully protected by intellectual property laws.
TuConnect Ownership. All software code, user interface designs, CSS architecture, HTML structures, logos, trademarks, database schemas, scoring algorithms, domain names, and brand assets ("TuConnect IP") are the exclusive property of TuConnect and its licensors.
Restrictions. You may not copy, modify, distribute, sell, lease, reverse engineer, decompile, or extract source code from any part of our platform without prior written permission.
Feedback & suggestions. If you submit ideas, feature requests, or feedback regarding TuConnect, we may use them without obligation, restriction, or financial compensation to you.
9. Employer Responsibilities (TuConnect Hire)
Employers and recruiters using TuConnect Hire must comply with specific operational and ethical standards:
Legitimate job postings. All posted roles must represent genuine, active employment or internship opportunities. Employers must not post fake listings, multi-level marketing (MLM) schemes, pyramid schemes, or roles requiring job seekers to pay application fees, training fees, or equipment fees.
Compliance with labour standards. Employers agree to comply with all local labour laws, including Kenya's Employment Act 2007, minimum wage regulations, equal opportunity laws, and fair hiring practices.
Confidential handling of candidate data. Candidate CVs, personal details, contact data, and assessment scores received through TuConnect Hire must be kept strictly confidential, accessed only by authorized hiring team members, and used exclusively for evaluating candidates for specified vacancies.
10. Job Seeker Responsibilities (TuConnect Grow)
Job seekers and professionals using TuConnect Grow agree to the following conditions:
Accurate representation. You agree to present your educational qualifications, work experience, technical skills, and certifications truthfully. Misrepresentation of identity or credentials may result in immediate account termination.
Application diligence. You are responsible for ensuring that custom CVs, cover letters, and application materials sent to employers meet the specific criteria of the roles you target.
Respectful interaction. Communication with recruiters, career advisers, or company representatives must remain professional, respectful, and transparent at all times.
11. Payments & Subscriptions
TuConnect provides transparent, flexible pricing across free tiers, pay-as-you-go credit packages, and employer subscription plans.
Free features. Account registration, profile setup, document drafting, and ATS score checks are free. No credit card is required to build or review your CV on TuConnect Grow.
Pay-as-you-go credits. Exporting formatted ATS-ready PDF resumes or premium documents uses pay-as-you-go credits (for example, 25 credits per PDF export, priced at KES 10 per credit / KES 250 total). Credits are non-expiring pay-as-you-go top-ups with no automatic recurring subscriptions or hidden charges.
Employer plans (TuConnect Hire). Employer subscription plans, job posting packages, and candidate pool access are billed in accordance with the pricing terms displayed at checkout. Rates are stated in Kenyan Shillings (KES) or US Dollars (USD).
Payment processing & refunds. Payments are securely processed via certified payment gateways (including Mobile Money / M-Pesa and major credit/debit cards). Due to the immediate digital delivery of credits and document exports, purchases are non-refundable once credits are redeemed, except where required by applicable consumer protection laws.
12. Third-Party Services
The Services rely on trusted infrastructure providers for cloud hosting, secure authentication, payment processing, email notification, analytics, and AI model execution.
External links & tools. TuConnect may contain links to external job portals, company career pages, social networks (LinkedIn, X), or educational platforms. We do not control and are not responsible for the privacy practices, content, terms, or availability of third-party websites.
Integrations. When you choose to connect third-party accounts (such as signing in via Google or LinkedIn), your interaction is governed by both these Terms and the privacy policies of those respective providers.
13. Service Availability
We strive to ensure continuous, reliable platform availability for job seekers and employers across Africa and globally.
Uptime commitment. We target 99.9% uptime for core platform services, using high-availability cloud infrastructure and automatic failovers.
Maintenance & updates. We may perform routine maintenance, software upgrades, or server optimisations from time to time. Where planned updates may interrupt service, we aim to schedule them during low-traffic periods and provide advance notice where feasible.
Unforeseen interruptions. We are not liable for temporary service delays, outages, or connectivity failures caused by internet service providers, telecommunication network disruptions, power outages, or force majeure events beyond our reasonable control.
14. Disclaimers
PLEASE READ THIS SECTION CAREFULLY AS IT DEFINES THE LEGAL LIMITATIONS OF OUR SERVICE WARRANTY.
"As Is" and "As Available". THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
No Employment Guarantees. TUCONNECT IS A CAREER TOOLKIT AND TALENT ECOSYSTEM. WE DO NOT GUARANTEE THAT JOB SEEKERS WILL SECURE INTERVIEWS, JOB OFFERS, OR SPECIFIC SALARY LEVELS, NOR DO WE GUARANTEE THAT EMPLOYERS WILL FIND QUALIFIED CANDIDATES FOR EVERY VACANCY. HIRING DECISIONS REMAIN THE SOLE RESPONSIBILITY OF EMPLOYERS AND CANDIDATES.
Accuracy of Content. WHILE WE WORK HARD TO MAINTAIN HIGH-QUALITY AI ADVICE, RECRUITER INSIGHTS, AND ATS SCORING LOGIC, WE DO NOT WARRANT THAT ALL PLATFORM CONTENT OR AI RECOMMENDATIONS ARE COMPLETELY ERROR-FREE OR SUITABLE FOR EVERY SPECIFIC INDIVIDUAL CIRCUMSTANCE.
15. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW IN KENYA AND INTERNATIONAL JURISDICTIONS:
Exclusion of Consequential Damages. IN NO EVENT SHALL TUCONNECT, ITS DIRECTORS, OFFICERS, EMPLOYEES, PARTNERS, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNATIVE, OR EXEMPLARY DAMAGES: INCLUDING LOSS OF PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION, LOSS OF REPUTATION, OR COST OF SUBSTITUTE SERVICES: ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICES.
Aggregate Liability Cap. TUCONNECT'S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES SHALL BE LIMITED TO THE GREATER OF: (A) THE AMOUNT YOU PAID TO TUCONNECT IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM; OR (B) KES 5,000 (FIVE THOUSAND KENYAN SHILLINGS).
16. Suspension & Termination
You or TuConnect may terminate your account relationship at any time.
Termination by you. You may stop using the Services and close your account at any time via your account settings menu or by emailing support@tuconnect.app.
Suspension by TuConnect. We reserve the right to suspend, restrict, or terminate your access to the platform immediately, without prior notice, if: (a) you commit a material breach of these Terms; (b) you violate our Acceptable Use Policy; (c) we detect fraudulent, abusive, or illegal account activity; or (d) we are required to do so by law or court order.
Effect of termination. Upon account termination, your right to access the platform ceases. Data retention and deletion are handled in accordance with Section 8 of our Privacy Policy.
17. Indemnification
You agree to defend, indemnify, and hold harmless TuConnect, its parent company, affiliates, officers, directors, employees, agents, and licensors from and against any third-party claims, liabilities, damages, judgments, losses, costs, or expenses (including reasonable legal fees) arising out of or relating to:
(a) Your breach of these Terms or applicable laws; (b) Any User Content uploaded or generated by you; (c) Your violation of any third-party right, including intellectual property or privacy rights; or (d) Fraudulent or unlawful actions conducted through your account.
18. Governing Law & Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the Republic of Kenya, without regard to conflict of law principles.
Informal resolution first. Before initiating formal legal proceedings, you and TuConnect agree to attempt to resolve any dispute, claim, or controversy through good-faith informal negotiations for at least thirty (30) days by contacting support@tuconnect.app.
Binding Arbitration & Jurisdiction. If a dispute cannot be resolved informally, it shall be submitted to binding arbitration in Nairobi, Kenya, in accordance with the rules of the Nairobi Centre for International Arbitration (NCIA), or brought before the competent courts of Kenya located in Nairobi.
19. Changes to the Terms
We may update these Terms from time to time to reflect platform enhancements, product updates, security improvements, or changes in legal regulations.
Notice of updates. When material changes occur, we will update the "Last updated" date at the top of this page and, where appropriate, provide notice via email or a prominent banner notification within your account dashboard.
Continued acceptance. Your continued access to or use of the Services after revised Terms become effective constitutes your acceptance of the updated Terms. If you do not agree to the new terms, you must discontinue using the platform.
